Jury Selection Begins Against BackPage.com Who Made $500 Million Displaying Ads for Prostitution

The infamous classified ad website Backpage’s founders, Michael Lacey and James Larkin, have long disputed claims of prostitution on their former classified ad website BackPage.com.  BackPage.com was started to compete with Craigslist.com. The co-founders of the alternative weekly Phoenix New Times have been hailed as free speech defenders by some.

The federal prosecution against the former owners and workers of Backpage.com, which was delayed by three weeks due to the passing of a key co-defendant, is getting close to opening arguments.

In 2018, the classifieds site Backpage.com made $500 million from displaying prostitution advertisements, prosecutors said. In 2018, the Justice Department reported that, seven individuals have been charged in a 93-count federal indictment with the crimes of conspiracy to facilitate prostitution using a facility in interstate or foreign commerce, facilitating prostitution using a facility in interstate or foreign commerce, conspiracy to commit money laundering, concealment money laundering, international promotional money laundering, and transactional money laundering. First Assistant U.S. Attorney Elizabeth A. Strange said in 2018, “It is appropriate that Backpage is now facing criminal charges in Arizona, where the company was founded, and I applaud the tremendous efforts of the agents who contributed to last Friday’s enforcement action and who assisted in obtaining the indictment in this case.  Some of the internal emails and company documents described in the indictment are shocking in their callousness.”

The federal prosecution against the former owners and workers of Backpage.com, which was delayed by three weeks due to the passing of a key co-defendant-James Larkin who committed suicide, is getting close to opening arguments. Jury selection has begun for the three-month trial.

Since Lacey and Larkin had their assets seized and were detained in 2018, the attorneys for the remaining five defendants, who are each facing 100 felony counts of assisting prostitution, money laundering, and conspiracy, have emphasized free speech as a primary argument.

Section 230, which was established in 1995, exempts service providers from liability for harmful or unlawful content posted on their websites, as long as the provider makes no further contributions to the content than the removal of obscene or illegal content.

According to the prosecution, the law does not protect unlawful speech, so the judge should forbid defendants from raising free speech as a defense. Humetewa concluded that they can classify their standard business operations as free speech because the onus of establishing that those actions were unlawful rests with the prosecution.

If Backpage only served as a third-party host of information, Section 230 would grant immunity. However, evidence in the previous trial supported the government’s assertions that Backpage officials changed advertising and suggested user adjustments to better evade detection by investigators.

The defendants, former chief financial officer John Brunst, former operations manager Andrew Padilla, and former assistant operations manager Joye Vaught could spend the rest of their lives in jail of the prosecution prevails.

ATP News: Andy Murray advances at U.S. Open with 200th major win

Andy Murray, the 2012 U.S. Open champion, reached this year’s second round by notching his 200th career major win with a victory over Corentin Moutet of France on Tuesday in New York.

Murray, 36, took nearly three hours to defeat Moutet in three sets, 6-2, 7-5, 6-3, and had high praise for his opponent after the match.

“Difficult match against a very skillful opponent, a very different game style to pretty much all of the guys on the tour now,” Murray said. “And, yeah, there were a lot of long points and tricky moments out there, a lot of stuff going on out there on the court. I did well to get it done in three sets.”

Murray had 45 winners against 23 unforced errors, while Moutet had 32 winners with 36 unforced errors.

Meanwhile, in his farewell U.S. Open appearance since announcing his pending retirement, American John Isner posted a straight-sets win over 22-year-old Argentinian Facundo Diaz Acosta, who was making his U.S. Open debut.

Following a 9-4 season in his first as head coach at Notre Dame, Marcus Freeman went out and found a pillar at the quarterback spot.

Hartman arrives with great fanfare after setting the ACC record with 110 touchdown passes and two bowl wins at Wake Forest in three seasons as their starting quarterback. The 24-year-old represents the stabilizer Freeman said he needed.

“There’s no substitution for experience. None,” Freeman said. “I don’t care if you’re the head coach or the quarterback. That’s what gives me confidence in Sam Hartman. There’s nothing that’s going to be able to make him too high or too low. He’s thrown interceptions. He’s made bad decisions. He’s made great plays and long touchdown throws. He knows what to expect. A deep stable of running backs and a prospect-laden offense line might make Hartman’s evening easier (the game kicks off at 7:30 p.m. local time).

Not knowing exactly what to expect from the offense brings a new wrinkle for the Fighting Irish defense.

First-year head coach Brian Newberry wants Navy to feature the disciplined and methodical approach the program is known for historically, but understands the need to stretch defenses and achieve better balance.

The Midshipmen spent part of spring practice working exclusively on shotgun looks that can be used for run or pass plays and even employed multiple-receiver packages. This might not get spread offense devotees excited, but Newberry believes the changes are for the better.

“We want to get off to a fast start,” Newberry said. “It’s hard to simulate what we do in practice. It’s hard enough to simulate what we do schematically, it’s even harder to simulate the speed at which we do it.”

Nick Ottinger locked down a spot in the Championship Four by winning at a virtual Dover Motor Speedway on Tuesday night in the second playoff race of the eNASCAR Coca-Cola iRacing Series.

Ottinger, in the No. 25 Chevrolet, led comfortably for the final five-plus laps, building a three-car-length lead over Steven Wilson the final time around the track and prevailing by 0.236 seconds.

“I was using the tires up quite a bit obviously at the end, but you’re going for a spot at the final four,” said Ottinger, a resident of Claremont, N.C. “You’re gonna go all out.”

With his victory, Ottinger joins Garrett Lowe as the drivers who will already be among those competing for $100,000 next month in Charlotte, N.C., where the season concludes at a virtual Homestead-Miami Speedway. That race will be presented live from the NASCAR Hall of Fame.

Ottinger was crowned the series’ champion in 2020.

Although Wilson came up just short, finishing in second in the No. 10 Ford, he was still pleased with his performance.

“I was pretty happy,” said Wilson, who hails from Iowa City. “If I had a couple more laps, I think I could have gotten there, but I’ll take it. … Hopefully we can just finish the job at Phoenix.”

Lowe placed third in the No. 15 Ford. Jimmy Mullis, in the No. 46 Chevrolet, and Tucker Minter, in the No. 33 Chevrolet, followed to round out the top five.

Last season’s champion, Casey Kirwan, finished seventh in the No. 95 Chevrolet.

The playoffs continue on Sept. 12 when the series heads to a virtual Phoenix Raceway for the penultimate race. ATP News: ESPN’s John McEnroe (COVID-19) off U.S. Open telecasts

Tennis legend John McEnroe is missing U.S. Open telecasts on ESPN due to testing positive for COVID-19.

McEnroe, 64, is ESPN’s lead analyst for the coverage of the Grand Slam event.

“Unfortunately, after feeling a bit under the weather, I tested positive for COVID,” McEnroe said in a statement released by ESPN on Tuesday. “I’m watching the U.S. Open from home and can’t wait to get back to work soon.”

ESPN said it would welcome McEnroe back once he’s ready to return.

McEnroe won four U.S. Open titles (1979, 1980, 1981, 1984) during his Hall of Fame career. Overall, he won seven Grand Slam crowns and 77 overall titles.

FRIENDLY News: Megan Rapinoe’s USWNT farewell: Sept. 24 in Chicago


Megan Rapinoe’s farewell appearance for the U.S. women’s national team will be a Sept. 24 friendly against South Africa at Soldier Field in Chicago.

“People may think that my career coming to an end would bring sadness, but when I think back on the past 30-plus years of playing this game, my overriding emotions are joy and gratitude,” Rapinoe said a release Tuesday from the U.S. Soccer Federation.

“It’s been an unbelievable ride. It will be special to have this one last opportunity to play for my country in front of our incredible fans and get the chance to thank my teammates and everyone who has had an impact on me as a person and player over the years.”

Rapinoe, 38, has registered 63 goals and 73 assists in 203 appearances with the USWNT from 2006-23. She helped the Americans win World Cup championships in 2015 and 2019 and an Olympic gold medal in 2012.

The midfielder announced before this summer’s World Cup that she would retire after the current NWSL season. Her last regular season match with the OL Reign is scheduled for Oct. 6 in Seattle against the Washington Spirit.

Women’s hockey league reveals first six franchises

The new Professional Women’s Hockey League announced its six inaugural franchises on Tuesday.

Three teams based in Canada and three in the U.S. will begin a 24-game regular season this January.

The American PWHL franchises will be based in Boston, Minneapolis-St. Paul and the New York City area.

The Canadian clubs will call Montreal, Toronto and Ottawa home.

Details on team names, logos and arenas will be announced at a later date.

PWHL board member Stan Kasten, president of the Los Angeles Dodgers, said many games will also be played at neutral sites.

“That means games in other cities that are not cities in our ‘Original Six,’ both NHL cities and possibly even non-NHL cities,” Kasten said, per ESPN. “In some of our markets where we are not playing [home games] in the bigger NHL venues, we will probably have events in those venues. We’ll be promoting those as special events.”

The NHL released a statement Tuesday supporting the new venture.

“The National Hockey League congratulates the Professional Women’s Hockey League on today’s announcements,” the league said. “We remain committed to supporting the women’s game and look forward to working together with the PWHL to grow our sport.”

Each team can sign up to three players during a Sept. 1-10 free agency period. A draft is scheduled for Sept. 18.
