Woman sues Lyft, claims driver sexually assaulted her multiple times

According to a complaint, a Leesburg, Florida, woman is suing ride-sharing company Lyft, alleging that one of its drivers viciously raped and pregnant her and that the business failed to protect her.

According to the complaint, Means claims that on April 28, 2019, she used the Lyft app to request a ride back to her accommodation following a night of drinking. She claimed that after telling her to sit in the front seat, the driver started making offensive remarks that made her uneasy.

The lawsuit states that after they got to their location, the driver parked and started inappropriately touching Means. The driver allegedly followed her into her home after she turned down his approach and got out of the car, where she was sexually assaulted and made to perform oral. Means alleges that when she pleaded with the driver to pull over, he once said, “It will be just fine and over.”

Following an April 2019 incident involving Tabatha Means and an unidentified Lyft driver, the lawsuit was filed on Tuesday in U.S. District Court in California. Means claims the driver followed her home after the ride and repeatedly sexually assaulted her while she was intoxicated. The allegation in the complaint is that Means’ kid was born after the alleged incident led to a pregnancy.

 

CNN reported, “Lyft has pushed back on the allegations in the lawsuit, telling CNN in a statement that the alleged assault took place during an “off-app” ride hours after an official Lyft ride with the same driver. The company also said it only became aware of the alleged incident years after it occurred.”

Responding to Lyft’s statement, Means’ attorney, Rachel Abrams, told People magazine, “As for the facts of Tabatha’s case, this incident involved a trip booked through the Lyft App, and Lyft’s attempt to deflect liability is a perfect example of its bad faith handling of this crisis.”

Means had three bleeding episodes before giving birth to her baby via emergency C-section, according to the complaint. The child was born at 33 weeks, and because of the early delivery, he spent almost a month in the NICU.

The complaint claims that Means later received an administrative order from Florida’s Child Support Services directing a collection of the Lyft driver’s DNA sample. According to the test results, there is a 99.9 percent chance that the Lyft driver is Means’s son’s father.

Lyft claims and defends that no customer service or safety complaint about the incident was submitted to Lyft. “No police report was filed for this incident, and police were never involved,”
