Federal prosecutors sent a letter to a Manhattan judge asking for Sam Bankman-Fried to be barred from using the encrypted social media platform Signal as they feared that he would possibly try to tamper with potential witnesses. They claimed that an attempt to do so was made, citing unreleased testimony from the former chief executive of Alameda Research.

According to a report in CNBC, the prosecutor’s letter wants Sam Bankman-Fried (SBF) to be barred from using software that is encrypted as it might “constitute witness tampering.” The filing also said that SBF had contacted the “current General Counsel of FTX US who may be a witness at trial” via Signal, on January 15, after over $5 billion was recovered from FTX assets.

Although the letter did not name him, Ryne Miller is the current counsel for FTX US as well as a former partner at Kirkland & Ellis.

According to the outlet, SBF allegedly told Miller, “I would really love to reconnect and see if there’s a way for us to have a constructive relationship, use each other as resources when possible, or at least vet things with each other.”

The prosecutors allege that the request by SBF might indicate that he was putting in an effort to influence the testimony of a witness. It also alleges that his effort to improve his relationship with the General Counsel of FTX US “may itself constitute witness tampering.”

The government filing also said that the former FTX CEO SBF, who has been charged with eight charges of fraud and pled not guilty, had also contacted other employees of FTX including current and former ones.

When asked for comment, both Ryne Miller and a representative for Sam Bankman-Fried declined to comment.

Former CEO of FTX saw his crypto exchange collapse in November, after reports that the company has allegedly used stolen customers’ funds to help Alameda Research surfaced. Sam Bankman-Fried has been released on a $250 million bond and is due to face federal court in October.
