The Donald Judd Foundation has sued reality star Kim Kardashian. In a video uploaded on social media, the Skkn by Kim founder gave a tour of her office and described its design. She included what she described as “Donald Judd tables.” The Donald Judd Foundation has objected to the video as the tables are not authentic. On Wednesday, they filed a lawsuit against Kim Kardashian and Clement Design, who made the tables.
In the video, Kim Kardashian says, “These Donald Judd tables are amazing and blend in with the seats,” and more.
The Wednesday lawsuit was filed in the US District Court for the Central District of California. According to the court filing, the set created by Clement Design looks a lot like the original Judd design. The Judd Foundation accuses the company of trademark and copyright infringement.
The lawsuit also says, “Consumers are likely to believe that Judd Foundation and the Donald Judd brand are connected or affiliated with, or otherwise sponsored or endorsed by Ms. Kardashian,” according to the New York Times.
It also says, “Judd Foundation categorically prohibits customers from using purchased Donald Judd furniture for marketing and promotional purposes.”
The Judd Foundation told the Times that it had contacted Kim Kardashian about the video three days after it was posted. The video was removed on Wednesday after the lawsuit was filed.
The outlet reported that a Kardashian spokesperson apologized and said they would “update the video caption with a retraction.”
The Judd Foundation insisted that the video be deleted and the furniture is “recycled.” It also wanted Kim Kardashian to apologize publicly. Still, her team offered a social media post promoting the Foundation, which broke down negotiations and led to the filing of a lawsuit.
Clement Designs released a statement arguing that it manufactures its tables using different woods and designs. Still, the Judd Foundation pointed out an invoice that says the tables are “in the style of Donald Judd.”
Rainer Judd, the minimalist artist’s daughter, said, “We are just doing our job to protect Donald Judd’s work. Not every artist foundation has the time or resources to do that.”
According to the NYT, the revenue from these exclusive tables accounts for nearly half of the Judd Foundation’s income. I spoke to Rainer, who said, “The furniture is integral to our financial stability.”
In the video, Kim Kardashian touted that the tables were Judd’s originals. Her representatives have not responded to the NYT’s request for comment. The NYT reported about the lawsuit and spoke to Donald Judd’s daughter, who runs the Donald Judd Foundation.
