Celebrity Alec Baldwin was in tears after a judge dismissed the case against him in the Halyna Hutchins accidental murder on the set of western film Rust in October 2021. Baldwin’s lawyers declared that the prosecutors had “concealed” evidence (bullets) from them and “buried” it in another case file. After a day-long hearing on Friday without the jury, Judge Mary Marlowe Sommer, who heard the case in New Mexico, dismissed the case with prejudice.
Judge Sommer said, “The state is highly culpable for failing to provide this evidence to the defendant.”
Judge Sommer added, “The state’s willful withholding of this information was intentional and deliberate. If this conduct does not rise to bad faith, it certainly does come so near to bad faith that it shows signs of scorching prejudice.”
Alec Baldwin sobbed when Judge Sommer outlined her decision: “The sanction of dismissal is warranted in this case.”
Alec Baldwin broke down in tears and hugged his wife, Hilaria, and his siblings, who attended the hearings to support their brother and his team.
Later, he stepped out after the case was dismissed and drove away from Santa Fe in an SUV without speaking to the media. The 66-year-old actor was greeted with cheers by his web fans.

Alec Baldwin had accidentally shot the cinematographer of the film Rust with an antique gun that was supposed to have blanks. He pointed the gun at Halyna, and it went off. A single bullet injured her and killed her and injured the director who is standing close to her. He survived his injuries. Alec Baldwin’s lawyers argued that he was doing his job as an actor and relied on other professionals to ensure gun safety.
Assistant director David Halls handed the gun to the actor and told him it was a cold gun. Armorer Hannah Gutierrez-Reed, 26, was supposed to have inspected the gun and ensured it had blanks. She was found guilty of involuntary manslaughter earlier in 2024.
