Donald Trump’s newest trial on whether he violated the 14th Amendment and whether he is ineligible to be on 2024 presidential ballot in Colorado began on Monday. The Denver District Court is hearing the arguments presented by a group of voters together with a liberal organization and by Trump’s team of lawyers.
According to CPR News Judge Sarah Wallace began the hearing on Monday on a light note when she said, “I think we have more lawyers and police officers than anybody else.”
Both the plaintiffs and the defense went through their opening statements and three witnesses are expected to be called. First witness to testify was Washington D.C. police officer Daniel Hodges.
Hodges relived the trauma of the assault in graphic terms that included the beatings, the chemical irritants and the huge size of the mob on Jan 6. The Metropolitan Police officer said that the mob had them “completely outnumbered, had us encircled” and more.
Hodges’s body cam footage has been submitted as evidence.
This lawsuit filed in Colorado wants Trump to be barred from having his name on the ballot under Section 3 of the 14th Amendment of the Constitution. This amendment came into being after the Civil War. It was added to prevent former rebels of the Confederate from assuming federal office.
The case is expected to be long drawn even if the plaintiffs win as it will then reach the Supreme Court. The Supreme Court has a 6-3 conservative majority. Three Supreme Court judges were appointed by Donald Trump, during his presidency.
Cases against Trump’s eligibility to stand as a candidate for the 2024 elections have also been filed in Minnesota, New Hampshire and Michigan.
Donald Trump is also facing other cases including a civil fraud lawsuit in New York, a case on attempt to overturn the 2020 election, in Fulton County Georgia and a case for the removal as well as the mishandling of classified government documents after he left office in January 2021.
