The Ninth Circuit Court of Appeals agreed to postpone the lady’s prison reporting date on Wednesday, giving her the legal win, she had been hoping for after making numerous attempts to have her conviction overturned. Theranos’ founder will continue to be free on bond as the court reviews her case thanks to the last-minute decision. This might allow her another month or so of freedom, but escaping jail beyond that seems doubtful.

Holmes’ bid for bail was denied by the lower court judge who presided over her trial and sentenced her to 11 1/4 years in jail last month. Ramesh “Sunny” Balwani, the president of Theranos, was given the same automatic reprieve prior to his prison surrender deadline, but the appeals court finally denied his application for bail while he disputes his conviction.

Evans was wearing blue trousers and a T-shirt, a bag over his shoulders, and a pink baby bouncer for their new baby.

Elizabeth will join her family if, by some tiny miracle, her present appeal is successful, and she is permitted to remain on bail while her appeals are being heard by the court. According to legal experts, Holmes faces a difficult challenge with her appeal because US District Judge Edward Davila granted her attorneys broad discretion to deliver her whole defense at trial, reports say.
