The state of Ohio is suing Norfolk Southern railroad company over the horrifying train derailment accident that has damaged the lives of thousands in the town of East Palestine, Ohio.
The Ohio Attorney General’s office filed a complaint against Norfolk Southern Railway in federal court on Tuesday, alleging that the company was negligent in causing the train derailment and toxic chemical releases last month in East Palestine, Ohio, and that it broke laws governing hazardous waste and water quality.
The lawsuit adds to the railway’s legal difficulties following the train disaster and subsequent leak of poisonous chemicals, which the complaint claims include more than 1 million gallons of dangerous materials. It tackles alleged damage to the state, its economy, and its natural resources.
Attorney General of Ohio Dave Yost announced that the state is suing Norfolk Southern in a federal court in Columbus to “hold Norfolk Southern financially liable” for the train derailment, which Yost said released over 1 million gallons of dangerous chemicals and “recklessly endangers” the local populace and natural resources.
According to a news statement issued on Tuesday, the state is attempting to recover court costs, missed taxes, and other sustained economic losses in addition to the expenditures and damages associated with the accident, emergency response, and cleanup.
The CEO of Norfolk Southern was questioned by the Senate on funding for families impacted by the incident in Ohio. During a congressional hearing, the chief executive of the company in charge of the February train derailment that left dozens of residents of East Palestine, Ohio homeless declined to declare whether his organization would offer the afflicted town complete financial support.
Norfolk Southern CEO Alan Shaw expressed regret during his testimony on Thursday before the Senate Environment and Public Works Committee for his organization’s part in the February 3 collision that resulted in a fire that released dangerous vinyl chloride into the sky. Shaw informed lawmakers that Norfolk Southern had given about $20 million in financial aid to nearby families as part of its efforts to assist the afflicted neighborhood. He claimed that the financial aid was only a down payment. “We will continue to invest in East Palestine for as long as it takes to help the community recover and thrive.”
