State House Bill 242 prohibits individuals from “recruiting, harboring or transporting” adolescents who are pregnant for abortions without parental permission. It further states that this behavior is unlawful even if the abortion is performed outside of the state. The abortion regulations in Idaho are among the strictest in the country. The measure makes it unlawful to assist a juvenile in obtaining abortion drugs without their parent’s or guardian’s permission. Both actions go under the new law’s definition of “abortion trafficking.” Gov. Brad Little signed the bill.
In the event that the county prosecutor, who ordinarily handles criminal matters, chooses not to file charges, the recently enacted HB 242 would grant the attorney general the power to bring legal action against those who break the law.
Pro Life Republican Idaho Gov. Brad Little signed the bill on the same day that both Planned Parenthood and the American Civil Liberties Union announced they were suing the state’s attorney general over a legal opinion that read state law as forbidding doctors from referring a patient out of state for abortion treatment.
When HB 242 becomes law, opponents are planning to file a lawsuit.
Oregon, Washington, Montana, and California are among the states that Idaho shares borders with and allow abortions. Since Idaho has an almost complete prohibition on abortions, Oregon’s Attorney General stated that the state’s Department of Justice’s creation of a legal helpline for abortion access earlier this year was crucial.
