The Progressive Corporation (PGR), a well-known provider of auto insurance, home insurance, and other financial services, found itself in hot water when it experienced a data breach that exposed the personal and financial information of its customers. The breach, which occurred in 2022, led to the unauthorized access of sensitive customer data, including names, addresses, social security numbers, and financial details.
In the aftermath of the breach, affected individuals filed seven separate class action lawsuits against Progressive, alleging negligence, breach of contract, and violations of various state data breach notification laws. These lawsuits sought to hold Progressive accountable for the data breach and demanded compensation for the harm caused.
Progressive is charged with failing to stop the data breach from happening and with keeping the matter quiet for too long. Progressive discovered on May 19 that some of its third-party call center workers had given their login information to unauthorized users, who subsequently used that information to access Progressive’s system and data.
The Consolidation Decision
The charges were consolidated, according to U.S. District Judge Patricia A. Gaughan, because they “allege similar instances of wrongdoing against Progressive.”
After Progressive announced a data breach in August, seven planned class action lawsuits against the insurance corporation were merged by an Ohio federal judge.
In a significant legal development, the presiding judge decided to consolidate these seven class actions into a single case. Consolidation in class action lawsuits is a procedural move where multiple similar lawsuits are combined into one, streamlining the litigation process and avoiding duplicate efforts. This decision to consolidate the Progressive data breach cases is significant for several reasons.
