 Celebrity Chadwick Boseman: Black Panther star dies after four-year battle with colon cancer

The beloved star Chadwick Boseman, 43 was  diagnosed with stage 3 colon cancer in 2016,  two years before the release of his Marvel blockbuster, Black Panther. With much sadness his colon cancer escalated to stage 4 over the last four years.

Chadwick kept his diagnosis very private and away form the press. He continued to work during his illness always giving an outstanding performance. Chadwick was the first African American Marvel hero playing the character of  the King T’Challa in the film Black Panther.

It is with immeasurable grief that we confirm the passing of Chadwick Boseman.⁣ ⁣ Chadwick was diagnosed with stage III colon cancer in 2016, and battled with it these last 4 years as it progressed to stage IV. ⁣ ⁣ A true fighter, Chadwick persevered through it all, and brought you many of the films you have come to love so much. From Marshall to Da 5 Bloods, August Wilson’s Ma Rainey’s Black Bottom and several more, all were filmed during and between countless surgeries and chemotherapy. ⁣ ⁣ It was the honor of his career to bring King T’Challa to life in Black Panther. ⁣ ⁣ He died in his home, with his wife and family by his side. ⁣ ⁣ The family thanks you for your love and prayers, and asks that you continue to respect their privacy during this difficult time. ⁣ ⁣ Photo Credit: @samjonespictures

His death occurred on the day the MLB celebrated Jackie Robinson day, honoring the first African American major league baseball player.

“He has played several historical figures, such as Jackie Robinson in 42 (2013), James Brown in Get on Up (2014), and Thurgood Marshall in Marshall (2017). His role as the superhero Black Panther in the Marvel Cinematic Universe films, including in Black Panther (2018), made him an international star, winning him a NAACP Image Award and a Screen Actors Guild Award.

Boseman’s other film roles included 21 Bridges (2019), which he also co-produced, and Spike Lee’s Da 5 Bloods (2020). His final film, Ma Rainey’s Black Bottom, will release posthumously on Netflix. He died on August 28, 2020 after privately dealing with colon cancer for four years.” Source Wikipedia

Hurricane Laura appears to have narrowly missed the heart of the U.S. fuel-making and chemicals infrastructure along the Gulf Coast, and caused less mayhem than forecasts predicted.

Officials still had to cope with a chlorine leak and fire at BioLab, a chemical manufacturing facility the Lake Charles, La., area, and Motiva Enterprises reported a leak at its Port Arthur, Tex., refinery, but said it occurred during the shutdown of the refinery before the hurricane had arrived.

While Laura has been downgraded to a tropical depression, almost 800K homes and businesses across Louisiana, Texas and Arkansas are still without power.

Beverage giant Coca-Cola Company (NYSE: KO) plans to lay off 4000 employees. The company has announced strategic steps to reorganize the company for future growth. Coca-Cola  will focus on new operating units both regionally  and locally allowing them to work with global teams for new ideas. Voluntary severance packages will be offered throughout its workforce in the United States and Canada, as well as Puerto Rico. Due to the effects of the coronavirus it will prepare for a global severance program costing  Coca-Cola up to 550-million-dollars for a  global reorganization.

Coca-Cola suffered   due to many entertainment centers including movie theaters that sell their soft drinks forced to close during the Covid-19 pandemic.

Herbalife Nutrition Ltd. Agrees to Pay Over $122 Million to Resolve FCPA Case

Herbalife Nutrition Ltd. (Herbalife), a U.S.-based publicly traded global nutrition company, has agreed to pay total penalties of more than $122 million to resolve the government’s investigation into violations of the Foreign Corrupt Practices Act (FCPA).   The resolution arises out of Herbalife’s scheme to falsify books and records and provide corrupt payments and benefits to Chinese government officials for the purpose of obtaining, retaining, and increasing Herbalife’s business in China.   This includes a criminal penalty of over $55 million and approximately $67 million to be paid to the U.S. Securities and Exchange Commission (SEC) in a related matter.

Herbalife entered into a deferred prosecution agreement with the Criminal Division’s Fraud Section and the U.S. Attorney’s Office for the Southern District of New York in connection with a criminal information filed today in the Southern District of New York charging Herbalife with one count of conspiracy to violate the books and records provision of the FCPA.

“By engaging in a decade-long scheme to falsify its books and records to conceal corrupt and other improper payments to Chinese officials and state-owned entities, Herbalife misrepresented important information made available to investors,” said Acting Assistant Attorney General Brian C. Rabbitt of the Justice Department’s Criminal Division.   “The integrity of our financial markets depends on the timely and accurate disclosure of material information about companies’ operations.   Today’s resolution reflects the department’s ongoing commitment to combating international corruption and ensuring that investors can trust the accuracy of the financial statements of publicly traded companies.”

“As admitted in the deferred prosecution agreement entered into today, Herbalife approved the extensive and systematic corrupt payments to Chinese government officials over a 10-year period to promote and expand Herbalife’s business in China,” said Acting U.S. Attorney Audrey Strauss of the Southern District of New York.   “Moreover, in an effort to conceal this widespread corruption scheme, Herbalife maintained false accounting records to mischaracterize these improper payments as permissible business expenses.   In addition to admitting its criminal conduct, Herbalife has agreed to pay combined penalties of more than $123 million.   This case signifies this Office’s commitment to ensuring that companies operating in the United States do not gain an unfair advantage through corruption and illegal bribes of foreign officials.”

According to its admissions, between 2007 and 2016, Herbalife knowingly and willfully conspired with others in a scheme to falsify its books and records and provide corrupt payments and benefits to Chinese government officials.   Herbalife carried out the scheme for the purpose of obtaining, retaining, and increasing Herbalife’s business in China by, among other things, (1)  obtaining and retaining certain direct selling licenses for its wholly-owned subsidiaries in China (Herbalife China); (2) improperly influencing certain Chinese governmental investigations into Herbalife China’s compliance with Chinese laws; and (3) improperly influencing certain Chinese state-owned and state-controlled media for the purpose of removing negative media reports about Herbalife China.

For example, in late 2006 through early 2007, during the time period that Herbalife China’s application for its first direct selling license was pending, Herbalife China provided corrupt payments and benefits to Chinese government officials, including government officials responsible for awarding that direct selling license, and falsely recorded and booked those corrupt expenses.   Around the same time period, an officer and high-level executive of Herbalife suggested to a high-level executive of Herbalife China that Herbalife China personnel falsify expense reimbursement documents in connection with entertainment of Chinese government officials.

Thereafter, Herbalife continued to provide improper payments and benefits to Chinese government officials.   Herbalife also continued to falsely record certain improper payments and benefits as “travel and entertainment expenses” and to maintain false Sarbanes-Oxley sub-certification letters in Herbalife’s books, records, and accounts.

As part of the agreement, Herbalife agreed to continue to cooperate with the U.S. government in any ongoing or future criminal investigations concerning Herbalife, its executives, employees, or agents.   In addition, under the agreement, Herbalife agreed to enhance its compliance program and to report to the government on the implementation of its enhanced compliance program.

The government reached this resolution with Herbalife based on a number of factors, including the failure to timely disclose the conduct that triggered the investigation; the nature and seriousness of the offense, which spanned approximately a decade and involved high level employees; the lack of an effective compliance program at the time of the misconduct; and credit for the company’s cooperation.   Herbalife also engaged in remedial measures, including terminating and disciplining individuals who orchestrated the misconduct, adopting heightened controls and anti-corruption protocols, and significantly increasing the resources devoted to compliance.

The criminal monetary penalty for Herbalife reflects a 25 percent reduction off the bottom of the U.S. Sentencing Guidelines fine range because of Herbalife’s full cooperation with the government’s investigation.

In a related matter with the SEC, Herbalife agreed to pay the SEC disgorgement and prejudgment interest totaling approximately $67 million.

The FBI’s New York Field Office investigated the case.   Trial Attorney Jason Manning of the Criminal Division’s Fraud Section and Assistant U.S. Attorneys Joshua A. Naftalis and Scott A. Hartman of the U.S. Attorney’s Office for the Southern District of New York are prosecuting the case.

The department appreciates the significant cooperation provided by the SEC in this case.   The Justice Department’s Office of International Affairs provided assistance.

WHERE IT CAN BE USED:

This test could be used at point-of-care settings, like a doctor’s office, emergency room or some schools.   This test has been authorized for use in patients suspected of COVID-19 by their healthcare provider within seven days of symptom onset. Given the simple nature of this test, it is likely that these tests could be made broadly available. Devistating Destruction as Hurricane Laura Rips Through the South East

Hurricane Laura made landfall around 1 a.m. over Cameron, Louisiana, as a Category 4 Major Hurricane with 150 mph winds.   Hurricane Laura continues moving north affecting the states of Louisiana, Texas, and Arkansas.  As we begin  to assess the damage, please continue to heed the warnings and instructions of your State and local officials as storm hazards will persist long after the storm has passed.

Hurricane Laura remains a deadly hurricane with devastating coastal storm surges, destructive winds, and flash flooding.   President Donald J. Trump was briefed earlier this week by Acting Secretary of Homeland Security Chad Wolf and Administrator of the Federal Emergency Management Agency   Peter Gaynor on the status of Hurricane Laura and the proactive preparations taken by the Administration, and he has continued to receive regular updates about the conditions on the ground.  President Trump is committed to deploying the full resources of the Federal Government to rescue those in distress, support those in the region affected, and restore disruptions to our communities and infrastructure.

Why Google’s Wearable Market is Much Better Than Amazon’s

Fitbit and the Apple watch may have some company with Amazon’s new fitness tracker called Halo. The wearable market is estimated to be worth 50 billion dollar this year alone.

Amazon recently announced the new health app called Halo. It looks to compete with Fitbit, Apple, and Google wearables.

Google Fit maintains an amazingly simple and clean interface that is   compatible app with the Android system and other fitness and health apps. You just download it to your Android or iOS and within seconds your phone becomes the hardware for the app. The app lets you monitor your movements and heart rates which are the metrics you need in order to get fit and healthy. Tracking your biometric data allows the app to collect additional information  from other devices such a smart watches, bathroom scales that have smart technology,   and fitness trackers. The more information you enter into the app. the better data will give you to improve your health and fitness.

Amazon is also late to the game. Other fitness trackers already have a loyal user base where those that have have already stored all their apps and data and don’t want to have to switch over and lose the information they currently have with Google Fit.

Tesla’s Breaking Announcement for Battery Day

Elon Musk, CEO of Tesla Motors, Inc. will announce   a groundbreaking major advancement in battery technology at its September 22nd, 2020 at The Battery Day Event. Tesla stock has blown up over 190% In the last two quarters.

Jefferies and Company analysts  maintain a buy rating on Tesla stock.

Tesla’s Battery Day is   a highly anticipated event. Teslas’s pilot battery production line is on its way to being finished and prepared for production. Make sure to watch CEO Elon Musk on Twitter as the Tesla’s Plaid Model S, and the Plaid Model X, may be debuted at Battery Day.

In other EV news- Xpeng (XPEV)   that competes with Tesla opens its IPO today. The company raised $1.5 billion in its IPO Thursday and traded up 60% at the opening trading on Thursday . Xpend does not actually make its own batteries but relies on other manufacturers to produce their technology.

Walmart Partners with Microsoft on TikTok Bid.

TikTok may have a buyer within as little as 48 hours. Microsoft is said to be the top contender  to purchase the company along with Walmart as the two companies’ team up to buy the TikTok. The sale could reach as high as 30 billion dollars. Walmart shares increased  more than 3% on the news.

Kevin Mayer, CEO of TikTok has resigned.Kevin Mayer was only with the company for three months. General Manager Vanessa Pappas will take over as interim CEO. President Trump stated TikTok was a national security threat and could share information about users in the U.S to China’s government.

TikTok, a video-sharing mobile application owned by the Chinese company ByteDance Ltd., has reportedly been downloaded over 175 million times in the United States and over one billion times globally.   TikTok automatically captures vast swaths of information from its users, including Internet and other network activity information such as location data and browsing and search histories.   This data collection threatens to allow the Chinese Communist Party access to Americans’ personal and proprietary information – potentially allowing China to track the locations of Federal employees and contractors, build dossiers of personal information for blackmail, and conduct corporate espionage.
