One Police Officer Indicted in Breonna Taylor Case

LOUISVILLE, Ky. (CN) – Only one of the police officers involved in the shooting death of Breonna Taylor will be criminally charged after a grand jury presented its findings on the case to a judge on Wednesday afternoon.

Brett Hankinson has been indicted on three counts of first-degree wanton endangerment. Kentucky Attorney General Daniel Cameron announced the decision in a 1:30 press conference that came eight days after the city of Louisville reached a $12 million  civil settlement  with Taylor’s estate.

Hankinson’s charges stem from shots he fired into adjacent apartments and are not specifically related to Taylor’s death.

His cash bond was set at $15,000.

Taylor, a 26-year-old Black woman, was shot and killed in her apartment on March 13 after police allegedly executed a no-knock search warrant in connection to a drug investigation involving her boyfriend, Kenneth Walker.

Hankison, one of the three officers involved in the shooting, was  fired  in June.  Though the boyfriend Walker fired a single shot at police during the incident, he  claimed in a lawsuit  earlier this month  that Kentucky’s “stand your ground law” protects him from any criminal liability as he acted in self-defense.

Cameron gave a lengthy statement Wednesday, and said he met with Taylor’s mother Tamika Palmer,before the grand jury presented its findings.

“The decision before my office as the special prosecutor,” he said, “was not to decide if the loss of Ms. Taylor’s life was a tragedy. The answer to that question is unequivocally yes.”

Cameron said his team used ballistics evidence, 911 calls and interviews to piece together the night of the shooting, and also worked with the FBI to arrive at their conclusions.

In a departure from previous reporting, Cameron said the officers knocked and announced their presence at Taylor’s apartment, and only breached the door once they received no response from the individuals inside.

He said this information was corroborated by an independent witness and reiterated that the warrant was not executed as a “no-knock” warrant.

The officers only fired at Walker and Taylor after Walker shot and wounded Mattingly, according to Cameron.

“Our investigation,” he said, “found that Mattingly and Cosgrove were justified in their use of force after having been fired upon by Kenneth Walker.”

Cameron told members of the media he knows that “not everyone will be satisfied” but stressed that he and his team sought the truth.

“If we simply act on emotion or outrage, there is no justice,” he said. “Mob justice is not justice. Justice sought by violence is not justice. It just becomes revenge.”

The ACLU released the following statement after the grand jury’s decision.

“Today’s decision is not accountability and not close to justice,” Carl Takei, senior ACLU staff attorney said. “Justice would have been LMPD officers never shooting Breonna Taylor in the first place. The choice to bring these charges alone, and so late, highlights the indifference to human life shown by everyone involved in Breonna Taylor’s murder.

“We will continue to fight alongside the members of the Louisville community and the larger movement to shift power and resources away from the racist and unjust institution of policing that regularly terrorizes our communities and the lives of those that we love,” Takei said.

Barriers were erected and several streets were blocked off in downtown Louisville Tuesday morning in anticipation of Wednesday’s announcement.

Additionally, the Jefferson County circuit, family, and district courts announced they would be closed from 11:30 p.m. Tuesday through the weekend.

Louisville Mayor Greg Fischer put a 9 p.m. curfew in place through Friday night, and said the emergency measures have been put in place to ensure the safety of the city’s residents.

“My hope,” Fischer said in a video statement Tuesday, “is that we will continue to see peaceful, lawful protests, which is what we have seen the vast majority of these last 100-plus days and nights.”

According to the Louisville Metro Police Department, the National Guard had been activated to help deal with any unrest.

Protesters gathered downtown through the early afternoon, and many expressed grief and outrage when the charges against Hankinson were announced.

“We have a long road ahead,” Cameron said, “as we address the pain in the Louisville community. I am committed to being part of the healing process.”

During his press conference, Cameron also announced the creation of a task force to review and reform the process of obtaining and executing search warrants throughout Kentucky.

“I choose the side of justice,” he said. “I choose the side of truth. I choose a path that moves the commonwealth forward and towards peace.”

She sets an example for others to be accepted for who you are despite that she’s been a Target about her sexuality, her weight, and grace. Lizzo has been living in Los Angeles since 2016. She recently appeared in this month’s issue of Vogue. She told vogue that “I always thought I needed at least two and a half white boys to make a song. One to engineer and one to produce. But now I can sit in my room and be my own engineer and producer.”

Lizzo   speaks about positive body awareness and that no one seems to bring up the fact about women that wear sizes 18 and up, have big stomachs, fat on their backs, in between their thighs, and stretch marks.

She’s all in for the body positive image no matter what shape or size you are. Many have criticized her about her weight and the fact that she accepts it. People that criticized her said that she should be working on losing weight, being healthy and not portraying images that it’s okay to be severely overweight.

One trainer is Jillian Michaels who defends her criticism of the celebrity’s singers’ weight. Jillian Michaels made a statement stating that obesity comes with serious consequences. She later followed up a statement on Twitter-““As I’ve stated repeatedly, we are all beautiful, worthy and equally deserving,” she wrote. “I also feel strongly that we love ourselves enough to acknowledge there are serious health consequences that come with obesity — heart disease, diabetes, cancer to name only a few.”

After the Closing Bell Report: Stocks to Watch September 23, 2020

Good evening, here are some highlights from today’s trading and news you can use for tomorrows trading day.

It certainly wasn’t a good day for the auto industry, or at least in California. Governor Gavin Newsom issued an executive order to restrict new car sales in the California to only zero-emission vehicles by 2035. The Governor also declared his  support behind a ban on the controversial use of hydraulic fracturing by oil companies.

The Dow falls 525.05 points, 1.9%, to 26,763.13. The S&P 500 lost 2.4% closing  at 3,236.92. The Nasdaq Composite closed 3% lower at 10,632.99.

JNJ enters phase three trial for Covid-19 vaccine.

Tesla sues U.S. government to overturn   President Trumps administration on   tariffs on   items Tesla imports from China. CEO, Elon Musk, gives guidance that the company’s vehicle deliveries in 2020 will increase up 30% to 40% from last year. Elon Musk also promised us a self – driving $25,000 Tesla to arrive in three years.

GoodRx, the company that helps consumer find prescription drugs at a discount rises 40% in market trading today after the company’s IPO today. The offer price was $33 per share. GoodRx was founded 2011 by Facebook veterans Doug Hirsch and software entrepreneur Trevor Bezdek.

Apple opens first India online store due to booming iPhone sales

The company promises Indian customers a full product range and the same exclusive experience found in Apple stores around the world.

“We’re proud to be expanding in India and want to do all we can to support our customers and their communities,” said Deirdre O’Brien, Apple’s senior vice president of retail and people, in a news release. “We know our users are relying on technology to stay connected, engage in learning, and tap into their creativity. … We are offering our customers the very best of Apple at this important time.”

Prime Minister Narendra Modi’s government, for its part, is keen on supporting Apple and other global manufacturers to make India not just a manufacturing hub but also an export center. It has been reaching out to companies that are looking to shift their bases from China.

After the Closing Bell Report: Stocks to Watch September, 22, 2020

Good evening, this is the after the bell report for September 22nd, 2020. It certainly has been a wild ride on Wall Street the past few weeks. Even after a correction the last two weeks, we are seeing wild rides with tech stocks.As the economy seems to rebound, many   companies’stocks have surged this week.

S&P 500    3,315.57   up   34.51         1.05%
Nasdaq 10,963.64    up 184.84     1.71%

The market is on shaky ground due to the upcoming elections and the fact that an economic stimulus may not reach Americans bank accounts anytime soon. House Democrats are still pushing for a $1200 stimulus check for American citizens.

In after-hours trading  Nike posted its fiscal first-quarter passing consensus estimates as sales increase with pandemic retail store closings now easing. Earnings per share came in at $0.05- $0.46 expected with $0.86   year over year.

Tech stocks rebounded today even though the day was negative for US stocks. Tesla lost 4%   of recent gains   on the day ahead of its battery day event which is scheduled for tomorrow September 23rd, 2020.

A bright spot in the market today is FROG, an IPO that was brought this week increasing today and closing at 77.71 rising up 15% for   the day. The company provides an end-to-end, hybrid DevOps platform allowing for continued software release management (CSRM).

Another bad day in the news for Amazon as a report was released today the company has fallen short in its commitment valuing social welfare and endangering the safety of its warehouse workers due to  being put at risk under the Corona virus pandemic . The report also States it retaliated against the employees who made negative statements about working conditions. Those workers were late later fired .

FVRR Is solid proof that the gig economy is in full force.   Companies are hiring freelance workers  and it seems as this will not cease to exist for an exceptionally long time. The stock closed at 133.07 per share today up five point 18% .

Notably, Pinterest made new highs today . Pinterest is now the number one free app on the Apple App Store it surges ahead above tick tock and zoom video. The stock had a blowout second quarter making the stock soar even higher.

Another company surging in today’s market is Carvana, the company that has disrupted the way consumers  to buy cars.  During the third quarter Carvana expects to set records in units sold and total revenue. The company did not issue further guidance today. Carvana said it expects to set records in several categories during its third quarter, including total revenue and retail units sold.   The company  trades on the New York Stock Exchange under the ticker symbol NYSE: CVNA. Shares closed today  at 226.83  At the clothes surging up +53.16 (30.61%).

Stitch Fix reported a fourth-quarter loss of $44.5 million down  44 cents per share, compared with earnings of $7.2 million, and  7 cents per share the prior year.

Carnival cruise lines is laying a large portion of its staff,   potentially in the thousands . It also is selling off some of its fleets.

Credit lines that will be available will start at $10K to $75K. Those amounts will be increased over time. Just like   applying for any business loan, those that are the most creditworthy will receive the best rates.

As America’s biggest retailer (as of 2019)  it still far outpaced Amazon in terms of revenue), it’s only logical that Walmart is rushing to keep up–and looking to cutting-edge tech to help. This week the company launched a pilot drone delivery program in Fayetteville, North Carolina. In partnership with drone company  Flytrex, the mega-retailer is initially planning to use drones to deliver grocery and household items.

Flytrex has been around since 2013, and has aimed to cater to people living in suburban areas; the company’s website emphasizes that urbanites have access to plenty of shopping and delivery options, while suburb-dwellers tend to be at least a few-mile drive away from stores and often don’t have access to a lot of home delivery services.

Goldman Sachs Group Inc. places a positive outlook on the stock market. Their announcement came at the time when JPMorgan Chase & Co.’s strategists reported a bullish outlook in the equity market. GS:US New York Goldman Sachs Group sees  a positive outlook on the restart of the economy.

The connection between the pandemic and our dietary habits is undeniable. The stress of isolation coupled with a struggling economy has caused many of us to seek comfort with our old friends: Big Mac, Tom Collins, Ben and Jerry. But overindulging in this kind of food and drink might not just be affecting your waistline, but could potentially put you at greater risk of illness by hindering your immune system.

Hear the word “nutrition,” and often what comes to mind are fad diets, juice “cleanses” and supplements. Americans certainly seem concerned with their weight; 45 million of us spend US$33 billion annually on weight loss products. But one in five Americans consumes nearly no vegetables — less than one serving per day.

When the emphasis is on weight loss products, and not healthy day-to-day eating, the essential role that nutrition plays in keeping us well never gets communicated. Among the many things I teach students in my nutritional biochemistry course is the clear relationship between a balanced diet and a strong, well-regulated immune system.

Along with social distancing measures and effective vaccines, a healthy immune system is our best defense against coronavirus infection. To keep it that way, proper nutrition is an absolute must. Although not a replacement for medicine, good nutrition can work synergistically with medicine to improve vaccine effectiveness, reduce the prevalence of chronic disease and lower the burden on the health care system.

The impact of the Western diet

Scientists know that people with preexisting health conditions are at greater risk for severe COVID-19 infections. That includes those with diabetes, obesity, and kidney, lung or cardiovascular disease. Many of these conditions are linked to a dysfunctional immune system.

Patients with cardiovascular or metabolic disease have a delayed immune response, giving viral invaders a head start. When that happens, the body reacts with a more intense inflammatory response, and healthy tissues are damaged along with the virus. It’s not yet clear how much this damage factors into the increased mortality rate, but it is a factor.

What does this have to do with nutrition? The Western diet typically has a high proportion of red meat, saturated fat and what’s known as “bliss point foods” rich in sugar and salt. Adequate fruit and vegetable consumption is missing. Despite the abundance of calories that often accompanies the Western diet, many Americans don’t consume nearly enough of the essential nutrients our bodies need to function properly, including vitamins A, C and D, and the minerals iron and potassium. And that, at least in part, causes a dysfunctional immune system: too few vitamins and minerals, and too many empty calories.

A healthy immune system responds quickly to limit or prevent infection, but it also promptly “turns down the dial” to avoid damaging the cells of the body. Sugar disrupts this balance. A high proportion of refined sugar in the diet can cause chronic, low-grade inflammation in addition to diabetes and obesity. Essentially, that “dial” is never turned all the way off.

While inflammation is a natural part of the immune response, it can be harmful when it’s constantly active. Indeed, obesity is itself characterized by chronic, low-grade inflammation and a dysregulated immune response.

And research shows
that vaccines may be less effective in obese people. The same applies to those who regularly drink too much alcohol.

How nutrients help

Nutrients, essential substances that help us grow properly and remain healthy, help maintain the immune system. In contrast to the delayed responses associated with malnutrition, vitamin A fights against multiple infectious diseases, including measles. Along with vitamin D, it regulates the immune system and helps to prevent its overactivation. Vitamin C, an antioxidant, protects us from the injury caused by free radicals.

Polyphenols, a wide-ranging group of molecules found in all plants, also have anti-inflammatory properties. There’s plenty of evidence to show a diet rich in plant polyphenols can lower the risk of chronic conditions, like hypertension, insulin insensitivity and cardiovascular disease.

Why don’t we Americans eat more of these plant-based foods and fewer of the bliss-based foods? It’s complicated. People are swayed by advertising and influenced by hectic schedules. One starting place would be to teach people how to eat better from an early age. Nutrition education should be emphasized, from kindergarten through high school to medical schools.

 

Millions of Americans live in food deserts, having limited access to healthy foods. In these circumstances, education must be paired with increased access. These long-term goals could bring profound returns with a relatively small investment.

Meantime, all of us can take small steps to incrementally improve our own dietary habits. I’m not suggesting we stop eating cake, french fries and soda completely. But we as a society have yet to realize the food that actually makes us feel good and healthy is not comfort food.

The COVID-19 pandemic won’t be the last we face, so it’s vital that we use every preventive tool we as a society have. Think of good nutrition as a seat belt for your health; it doesn’t guarantee you won’t get sick, but it helps to ensure the best outcomes.The Conversation

Amazon has just launched a new spin bike to compete with Peloton.

The   Amazon Prime bike is manufactured in partnership with Echelon, a company that also competes with Peloton. The   Amazon Prime bike price point comes in at $499. The bike doesn’t   have a screen built in    between   the handlebars, but you can use a laptop or an iPad to access the app for cycling classes available.

In other Fitness news, Lululemon just  Mirror a 500-million-dollar valuation. Peloton has done extremely well during Covid-19 with sales soaring up 172%. Gyms are closing all around the United States do to force closures from the pandemic. Gold’s Gym, 24 Hour Fitness,  filed bankruptcy earlier this year and Flywheel spinning studio also declared bankruptcy.

17 analysts offering 12-month price targets for NASDAQ:  Peloton Interactive  in the last 3 months. The average price target is $78.88 with a high forecast of $109.00 and a low forecast of $58.00. Revenue and Cost of Goods Sold

We had revenue from sales of our product for the three months ended June 30, 2020 of $14,219,424, as compared to $10,153,044 for the three months ended June 30, 2019, an  increase of 40%. The increase in sales is due to the expanded distribution of our products to additional retailers throughout the country and increased demand due to Covid-19.

We distribute our product through several channels. We sell through large national distributors (UNFI, KeHe, C&S, and Core-Mark), which together represent over 150,000 retail outlets. We also sell our product directly to retail clients, including convenience stores, natural food products stores, large ethnic markets, and national retailers. Some examples of retail clients are, Walmart, CVS, Family Dollar, Albertson/Safeway, Kroger, Schnucks, Smart & Final, Jewel-Osco, Sprouts, Bashas’, Stater Bros.
