An 11th-grader of a reputed public non-specialized school in New York City was sexually assaulted in a restroom by a classmate, reports say. The incident was reportedly videotaped by the offender and the recording was circulated among other students, a new lawsuit claim.
According to “Jane Doe,” as the teen girl been named, and the lawsuit, the school did not call the police, an assistant principal even questioned her about the video playing around the school, the New York Post reported. The lawsuit said, “the assistant principal forced Jane Doe to write a statement describing her sexual assault without regard to her status as an underage victim of sexual assault or her apparent emotional and psychological trauma.”
Her father, who goes by “Joe Doe,” asserts that the school was aware that his daughter had previously been harassed and that the suspect “had a reputation for engaging in dangerous behaviors.” The girl, who is from an Islamic nation in the Middle East, could face the death penalty if she ever returns and authorities find out about the assault, he further warned. Friday’s filing said that this occurred while she was by herself in the assistant principal Jason Koch ‘s office.
On November 4, 2021, a male student at the Chelsea school on West 17th Street is alleged to have followed her into the first-floor girls’ bathroom and sexually assaulted her there. The boy “demanded” her to give him oral sex, which she told him declined she didn’t want to do, according to the lawsuit, which names the alleged attacker as N.R. Without her consent, the lawsuit claims that N.R. “forced her into a bathroom stall,” “pushed [her] onto the floor,” “held the back of her head,” and forced her into the sex act. Doe learned later that N.R. had recorded the incident on his cellphone, shown it, and sent it to other students.
Joe and Jane Doe contend that the school should have protected her given that her father had previously reported that his daughter had experienced bullying and had been physically assaulted by a fellow student in October 2019. The assistant principal had allegedly turned down Doe’s father’s request to transfer her after the earlier incident. The school was negligent in failing to properly investigate and report the sexual assault, in failing to keep an eye on the hallways, and in failing to provide adequate security.
