The state Court of Appeals’ decision centered on including “Molineux witnesses,” referring to individuals who testify about criminal acts not directly charged against the defendant. These witnesses, including Filipino Italian model Ambra Battilana Gutierrez, testified about alleged assaults by Weinstein that were not part of the charges against him. While some argue these witnesses were crucial in establishing a pattern of behavior, others contend their inclusion unfairly prejudiced the jury against Weinstein.
Weinstein’s defense argued during the appeals process that the additional witnesses tainted the trial and undermined the presumption of innocence. The court’s ruling seems to underscore the challenge of balancing the need for evidence of a pattern of behavior with the risk of prejudicing the jury.
