On Friday, federal agents arrested a prominent artist and activist who identifies as ‘queer non-binary’ for attempting to arrange anal sex with a nine-year-old boy in New York.
The US District Attorney’s Office charged 35-year-old Efrem Zelony-Mindell with attempting to entice a child, as well as possessing and distributing child pornography, all of which are felonies. Agents say Zelony-Mindell, who uses the pronouns they/them, was investigated after sending an encrypted message to an undercover agent posing as the father of the Manhattan boy in April.
Prosecutors wrote in the messages that Zelony-Mindell tried to set up a date with the boy, expressing “in graphic and unambiguous terms” his desire to engage in sexual activity with minor children. The suspect also claimed that the boy would be drugged prior to the encounter. Mindell, who uses they/them pronouns, was investigated after sending an encrypted message to an undercover agent posing as the father of the Manhattan boy in April.
US Attorney for the Southern District of New York Damian Williams described how Zelony-Mindell first came under his office’s radar last April. According to the federal prosecutor, Zelony-Mindell contacted the undercover agent, believing he was the child’s father, who was actually working for the FBI. They allegedly attempted to arrange anal intercourse with the boy via his father.
Zelony-Mindel met with the undercover officer on a Manhattan street corner on Friday, Williams said, with the expectation that he would take them to meet the boy and sexually assault him while the boy was partially drugged.
The incriminating images sent by Zelony-Mindell, who posed as Evan Smith in conversations with the officer, included one of “a boy of approximately four years of age being forced to perform oral sex on an adult male” and another of “an adult male holding a boy of approximately 12 years of age whose penis and anus were exposed.”
Instead, federal agents in charge of the investigation arrested Zelony-Mindell, who was later charged with possessing and distributing child pornography based on images and videos. If convicted, Zelony-Mindell faces a maximum sentence of life in prison for the enticement charge and a maximum sentence of 20 years for each of the child pornography charges. The artist has allegedly admitted to possessing and distributing child pornography.
