FDA propose ban on BVO, an additive used in fruit-flavored sports drinks and sodas

On Thursday, the Food and Drug Administration (FDA) proposed a ban on the brominated vegetable oil (BVO) as a food ingredient in beverages. BVO has been an ingredient in several popular beverages but was phased out by many large beverage manufacturers after it was banned in other countries due to its potential health risks. Some small grocery stores and regional beverages including Sun Drop citrus-flavored soda continue to use it in the U.S.

Brominated Vegetable Oil has been used in sodas to prevent the separation of ingredients. Studies have shown that it is potentially toxic to the thyroid, an essential gland in the body. Earlier, studies showed that it might have a detrimental effect on organs such as the heart and liver and could also cause neurological problems.

In 1970, the FDA had removed BVO from the “Generally Recognized as Safe and Effective” list. However, it said that the additive could be used on an “interim” basis. The agency will accept public comments on this proposed rule till January 17.

If it succeeds in banning BVO, the FDA said that beverage makers would get at least a year to reformulate or relabel the products that they have been making, before it enforces the new rule.

The FDA is also reassessing another additive called red dye No. 3. This synthetic dye is considered to be a potential cancer-causing additive.

In October, California became the first state in the nation to ban four additives—red dye No.3, brominated vegetable oil, potassium bromates and propylparaben. The new law will be implemented in 2027, giving brands who use the above additives sufficient time to reformulate. These additives have the potential to cause various health problems in both children and adults.

Some large food producers including confectioners have slammed California’s government for passing the law. Assembly members in the Golden State think that the law will bring a faster review of these potentially harmful additives by the FDA and this will lead to companies using alternative ingredients that are already used in several countries around the world.
