A famous lawyer in Minnesota pleaded guilty to a misdemeanors charge. Last October, an award winning lawyer of a prominent firm that deals with traffic accidents, personal information and more hit a construction worker and drove away in his SUV. He was drunk. He claimed that he was unaware that he hit a person. He said that he thought he hit a neon orange road sign and said would have stopped if he thought he had hit a human.
On Tuesday, June 11 James Patrick Carey of Edina, Minnesota pleaded guilty to a gross misdemeanor of criminal vehicular operation resulting in bodily harm. He admitted that he was under the influence of alcohol. He appeared in Pine County District Court. The agreement between Carey and Pine County Attorney’s Office includes four years of probation and a $900 fine, instead of a 365 day jail term.
Carey also has to submit to chemical testing and take part in drunk driving victim impact panel (Mothers Against Drunk Driving panel). He will submit to random testing of alcohol or drugs use. He has to write an apology letter to his victim. He has to complete 80 hours of community work service. It cannot include pro bono legal services or anything connected with his profession.
The accident took place on October 6, at about 11.40 a.m., on Interstate 35 near Hinkley. Carey hit Joseph G. Flanagan of Duluth with his SUV and drove away. The 27-year old worker was hospitalized and treated for injuries.
The construction worker was found in a ditch by a trooper. He was wearing a neon construction vest. The officer also found tire tracks nearby. Carey was stopped by the police about 35 miles away near Moose Lake, and smelled of alcohol. His blood alcohol level was found to be 0.143 percent much above the legal limit of 0.08 in Minnesota.
Duluth News Tribune also reported that the 64-year old lawyer admitted that he had drunk three glasses of wine and had also taken sleeping pills the day before he crashed against a construction worker. He said that he had not been sleeping for a few days after one of his family members had died.
James Carey president of the renowned firm SiebenCarey is scheduled to appear before a judge on September 4. The judge will decide whether or not to accept the plea deal.
