In a decision on Tuesday, a California judge let the lawsuit against Snap, which was filed by the parents of children who overdosed on narcotics they thought they had bought through the app, go to trial.
The lawsuit claims that certain of Snapchat’s unique characteristics, such as its geolocation capabilities, automatically deleted messages, and the “My Eyes Only” privacy feature, make it more difficult to monitor criminal activity and are particularly appealing to drug sellers.
The complaint filed in April 2023 stated, “Snap and Snapchat’s role in illicit drug sales to teens was the foreseeable result of the designs, structures, and policies Snap chose to implement to increase its revenues.”
In October 2022, relatives of more than sixty youths who overdosed on fentanyl filed a lawsuit against Snap due to the messaging app’s vanishing message function. “Snap and Snapchat’s role in illicit drug sales to teens was the foreseeable result of the designs, structures, and policies Snap chose to implement to increase its revenues,” according to an expanded version of the complaint filed in April 2023.
After consuming the medications purportedly acquired through Snapchat, a youngster passed away in all but two of the cases. Snapchat tried to get the case dismissed but the judge overruled Snap’s objections to 12 of 16 claims in the lawsuit.
