Israel Sanchez was walking to a grocery store in March when he was fatally struck by a Black GMC Yukon, which was turning left as Sanchez crossed a street within a painted crosswalk, according to the family’s attorneys.
The 47-year-old was taken to a hospital, where he was pronounced dead. Sanchez’s family identifies Josh Klinghoffer as the driver, stating that he stopped at the scene but was neither arrested nor charged with a crime.
Josh Klinghoffer, 44, played with the Red Hot Chili Peppers for 12 years, from 2007 to 2019, and is now on tour with Pearl Jam.
According to the lawsuit, Sanchez paused at the corner to ensure traffic had cleared shortly before being struck.
The suit states that he was walking within a marked crosswalk and was halfway across the westbound West Main Street side when Klinghoffer, driving a 2022 GMC Yukon without license plates, made a left turn and hit him in the back.
Klinghoffer’s attorney, Andrew Brettler, said in a statement Wednesday that his client was involved in a “tragic accident.”
“After the car struck the pedestrian, Josh immediately pulled over, stopped, called 911, and waited until police and the ambulance arrived. He is fully cooperating with the traffic investigation,” Brettler said.
Sanchez family attorney Nick Rowley stated that Klinghoffer “should be arrested and prosecuted for homicide.”
He also called the incident a “reckless homicide” that law enforcement has failed to investigate appropriately.” “They never charged the guy or even wrote him a ticket for blowing through the crosswalk and killing someone,” Rowley said. “This is a horrific injustice.”
Sadly, Mr. Sanchez dies at a hospital about 2 and ½ hours after the collision, the complaint in the lawsuit states.
