FTX Sam Bankman-Fried files long brief for new trial, blames rushed judgment

CWEB News investigates the possibility that Sam Bankman-Fried (SBF)—the disgraced founder of the collapsed cryptocurrency exchange FTX—could serve less than his 25-year federal prison sentence for fraud and conspiracy. Under certain conditions, SBF may be eligible for early release, potentially reducing his time served by up to four years or more.

Federal Sentencing Policies May Shorten Term

According to standard policy from the Federal Bureau of Prisons (BOP), as reported by CWEB News, federal inmates may earn “Good Conduct Time” (GCT) credits. These credits can reduce a sentence by up to 54 days per year for maintaining good behavior and actively participating in approved prison programs.

While the BOP has not issued a public statement regarding SBF’s incarceration or possible release date, sources familiar with federal sentencing practices confirm that such credits are routinely applied.

Additional Pathways for Sentence Reduction

CWEB News notes that two additional mechanisms may contribute to a shorter sentence:

  • Credits for participation in designated rehabilitation programs under the First Step Act.

  • Time served before sentencing is typically credited toward the final prison term.

Though SBF’s legal team has declined to comment on any potential reduction, CWEB News confirms that his attorneys continue to pursue an appeal of the conviction. Their most recent legal filing occurred in April 2025.

In a related development, sources close to the matter suggest that SBF’s parents, Stanford Law professors Joe Bankman and Barbara Fried, are lobbying for a potential presidential pardon, though no formal petition has been confirmed.

Conviction Background and Current Status

Sam Bankman-Fried was sentenced to 25 years in prison after being convicted on seven counts of fraud and conspiracy in 2023. Prosecutors alleged that SBF misused approximately $11 billion in customer funds, transferring assets between FTX and its affiliated hedge fund, Alameda Research, which was at one point run by his former girlfriend, Caroline Ellison.

Several FTX and Alameda executives accepted plea deals. Ellison, who testified against SBF, received a six-month sentence reduction and is currently scheduled for release in May 2026.

Earliest Possible Release Date

Taking into account standard GCT credits and other potential sentence reductions, CWEB News estimates that SBF could be eligible for release as early as December 14, 2044. Additional reductions could be applied over time, depending on his conduct, program participation, and any legislative or executive developments.
