Chipotle (CMG) sues Sweetgreen of violating its trademark by selling a bowl of “chipotle chicken.” Chipolte filed a lawsuit against Sweetgreen Inc., a fast-casual rival, in federal court in California on Tuesday, alleging that the salad chain’s new “Chipotle Chicken Burrito Bowl” infringes on its trademark rights. In a statement, Chipotle’s chief corporate affairs officer Laurie Schalow said the business would “take appropriate actions whenever necessary” to protect its trademarks.
Prior to bringing the complaint (Chipotle Mexican Grill Inc v. Sweetgreen Inc, U.S. District Court for the Southern District of California, No. 8:23-cv-00596.) in federal court in California, Chipotle said it had sent the salad restaurant a cease-and-desist letter. The Chipotle Chicken Burrito Bowl profits that Sweetgreen makes are also being sought by Chipotle in the court’s request for an injunction against Sweetgreen.

In addition, according to Chipotle’s lawsuit, Sweetgreen’s menu item marketing utilizes the word “Chipotle” in a font like the burrito chain’s stylized emblem and occasionally employs a red color resembling Chipotle’s Adobo Red. According to Chipotle’s complaint, Sweetgreen’s website prominently displays the product name over all other identifying characteristics that link it to Sweetgreen.
