Celebrity Sofia Vergara, the brand ambassador for several leading companies, and her former fiancé, celebrity Nick Loeb, underwent an in vitro fertilization process in 2013. In 2017, she filed legal papers in California to prevent Loeb from using the frozen pre-embryos they produced through IVF at the ART Reproductive Centre in Beverly Hills without her written authorization. After years of difficult litigation, in 2021, the judge issued a permanent injunction preventing Loeb from obtaining the embryos.
Loeb is going back to court to fight for the frozen embryos. The businessman is not done yet and has decided to sue the reproductive clinic following a legal dispute that began in 2014.
The businessman alleges that the medical staff at the ART Reproductive Centre in Beverly Hills never informed him that the embryos would be destroyed in the event of the couple’s breakup or that Vergara may prevent him from getting them.

The director, in a sworn declaration, claimed that the reproductive clinic was required to give him and Vergara a written advance directive outlining what would happen to the embryos in a variety of scenarios, including their breakup as a couple. Loeb asserts that ART never gave the couple such a form or engaged in such a conversation with them.
According to court documents filed by ART’s attorneys, Loeb and Vergara produced two pre-embryos that are “cryopreserved” at ART. They stipulated in writing that neither party could use the information to conceive a child without the other’s prior written authorization.
After the couple’s separation in 2014, Loeb initially sued Vergara in California to carry two female embryos to term that they had developed and intended to use with a surrogate. When that judge decided in Vergara’s favor, Loeb filed a new lawsuit in Louisiana, one of the states with the strongest anti-abortion laws in the nation.
To grant the embryos legal status, he established a trust for them in the state. In 2021, Loeb lost the legal dispute, and the judge issued a permanent injunction preventing him from getting access to the embryos. It is yet unknown if the embryos have already been disposed of.
To pay for his legal bills, the celebrity’s ex-fiancé is now suing ART for damages. The judge earlier decided that he would not be permitted to seek damages for emotional distress resulting from not having the children.
