An arrest affidavit in Clearwater, Florida, states that Nicholas Bollea was pulled over by a police sergeant on Gulf to Bay Boulevard. He had failed to move over a lane for three patrol vehicles that were conducting a traffic stop.
The police sergeant reported that 33-year-old Bollea had shown signs of impairment. His field sobriety tests’ performance was poor. His breath had a strong alcoholic odor, and his balance was also unsteady. He refused to take a test for breathing alcohol content (BAC).

Police arrested Bollea at 1.42 a.m. on Saturday. He was charged with misdemeanor for driving under the influence (DUI) and for refusing to take a sobriety test.
Online records showed that he was released later in the evening, the same day with a bond assessment of $500.
