Stand-up comedian, actress, and writer Sarah Silverman, author Christopher Golden, and novelist Richard Kadrey have filed lawsuits against OpenAI, for copyright infringement claims. The authors allege that the company’s AI model, ChatGPT, produces summaries of their books without their consent. They argue that their works were used as training data without permission, obtained from illicit “shadow library” websites, where books are available via torrent systems.
ChatGPT is a generative AI model that relies on vast amounts of information from websites, news articles, books, and other sources to generate convincingly natural responses. Exhibits presented in the OpenAI suit demonstrate how ChatGPT can summarize Silverman’s memoir “Bedwetter,” Golden’s “Ararat,” and Kadrey’s “Sandman Slim” without reproducing any copyright management information included in the original works.
The plaintiffs claim that OpenAI has profited from their copyrighted material and are seeking a jury trial and damages, including statutory compensation. While the specific books used in the datasets for training ChatGPT have not been disclosed by OpenAI, the court document suggests that “shadow library” websites, which aggregate content illegally, are the likely sources.
Daniel Gervais, a law professor at Vanderbilt University, predicts an increase in copyright law lawsuits related to generative AI in the future. In June, the Authors Guild published an open letter urging chief executives of Big Tech and AI companies to obtain permission from writers and compensate them fairly for using their copyrighted works in AI training.
In separate lawsuits against Meta, the authors allegedly claim that their books were accessible in the datasets used to train Meta’s Large Language Model Meta AI (LLaMA) models. Both lawsuits argue that the authors did not consent to their books being used as training material, and they seek damages for copyright violations, negligence, unjust enrichment, and unfair competition.
These lawsuits highlight the growing need to address copyright issues in the context of generative AI and the importance of obtaining proper consent and compensation for the use of copyrighted material in AI training.
