California Health Committee Approves Bill to Ban Sale of Food with Cancer-Linked Additives

The Assembly Health Committee has unanimously approved Jesse Gabriel’s (D-Woodland Hills) proposal to outlaw the sale of processed foods containing specific hazardous and harmful chemicals. Red 3, a food color used in some candies, is one of the substances in question. Previous studies connected it to cancer in animals after exposure. By a vote of 12-1 on Tuesday, the state Assembly’s Committee on Health approved the legislation and forwarded it to the Committee on Environmental Safety on Toxic Materials.

Assembly Bill (AB) 418 is a groundbreaking proposal that would outlaw the production, distribution, or sale of any food items in California that contain Red Dye No. 3, Potassium Bromate, Titanium Dioxide, Brominated Vegetable Oil, or Propyl Paraben.

Due to scientific research showing major public health consequences, such as an increased risk of cancer, behavioral problems in children, harm to the reproductive system, and damage to the immune system, each of these compounds is officially prohibited in the European Union (EU).

In processed foods and candies that are disproportionately marketed to children, low-income customers, and communities of color, many of the hazardous ingredients that are already illegal in the EU and other countries can be found. Manufacturers have modified their formulations and substituted safer additives where these hazardous compounds are prohibited. Assembly-member Gabriel displayed Skittles bought in France and Denmark, both of which contain no traces of the hazardous substance currently present in Skittles, during the Assembly Health Committee meeting in the US.

The Environment Safety and Toxic Materials Committee of the state, which is in charge of regulating hazardous and toxic materials, will now review AB418. The entire state Assembly will vote on the resolution after it passes the committee. It will then make its way to Gov. Gavin Newsom’s desk for his signature if it successfully completes the same procedure in the state Senate. The bill is expected to go into force on January 1, 2025, according to lawmakers.

This bill would prohibit the manufacture, sale, delivery, distribution, hold, or offering for sale of any food product that contains five specified substances, including, brominated vegetable oil and red dye 3. Red 3, a food dye, despite being removed from cosmetic products in 1990 for these reasons, remained in many foods and sweets, such as pastries and morning cereals.
