State legislation targeting TikTok is expanding. According to Reuters, Alabama and Utah have now joined Texas, Maryland, Nebraska, South Carolina, and South Dakota in banning the short-form video app from being used on state government computers. The state decisions follow FBI director Christopher Wray’s warning that TikTok, owned by the Chinese corporation ByteDance, has the power to change content and, if they so want, utilize the app for influence operations. He also cautioned about the possibility of espionage using the data.
Indiana became the first state in the United States to sue TikTok last week when it filed two cases against the social media site. The state bans the app along with Maryland, Texas, South Dakota, and Utah, while congressmen from other states (Wisconsin, Virginia) call for additional states to follow suit. Rep. Mike Gallagher (R-Wisc.) has now proposed a potentially bipartisan bill that would prohibit the social media platform statewide on grounds of national security.
The use of TikTok on state-owned devices is prohibited by an executive order signed by South Dakota Governor Kristi Noem, who cited security issues related to the app’s Chinese proprietors. In an effort to exclude any chance that the Chinese government could access the data held by ByteDance, the parent firm of the TikTok app, several members of Congress and federal regulators have advocated for further limits on the service. So far, regulation haven’t resulted in legislation or policy.

CNBC reports, “The ANTI-SOCIAL CCP ACT (which stands for Averting the National Threat of Internet Surveillance, Oppressive Censorship and Influence, and Algorithmic Learning by the Chinese Communist Party) explicitly names ByteDance and TikTok as subject to the restrictions in the bill, “unless and until the date on which the President certifies to Congress that the company no longer meets any of the conditions described,” such as being subject to “substantial influence” by a country of concern.”
