On Friday, attorney Brian Panish, who is representing the estate of Halyna Hutchins, the cinematographer who was fatally shot on the set of the Western “Rust” shot in New Mexico, slammed his behavior. The estate is suing actor Alec Baldwin and several others including the armorer Hannah Gutierrez-Reed, who has in turn sued the supplier of ammunition to the set.
Baldwin’s attorneys had earlier filed for an arbitration demand. They said that Halyna Hutchins had told Baldwin to point a gun at her and fire. It mentioned that both of them, the actor and the cinematographer had believed the gun to be a “cold” one, meaning a gun that had no live ammunition.
Attorneys for Baldwin also claimed that he was shielded from financial responsibilities related to her death. They also maintained that the $7 million film could not be completed as Hutchins’ estate had filed a lawsuit.
In the aftermath of the deadly shooting at the set of Rust both the 63 year old actor and Matt Hutchins Halyna’s husband had shared personal texts and more. Baldwin had tried to convince the cast and crew to continue shooting so the proceeds could to be used to help her family.
The filing also said that the incident that took place at the set of Rust was “a rare instance when the system broke down” and although someone should be held legally culpable, that person was “not Alec Baldwin.” It also noted that October 21, 2021 was the worst day in the actor’s life and the day had and would continue “to haunt Baldwin.” It also mentioned that an actor could not rule that a gun was safe. It was the responsibility of the professionals on the movie set.
However, attorneys for the Hutchins estate refuted the claims in the filing and said that it was “shameful” to say that Hutchins’ filing a wrongful death lawsuit had stopped the production of Rust.
Lawyer Panish told Deadline that Alec Baldwin was trying to “avoid liability and accountability” for his actions that took place before and on October 21 and that these actions resulted in Halyna’s death.
