Last year, on October 21, an unforeseen tragedy occurred at the set of “Rust.” Celebrity actor Alec Baldwin fatally shot cinematographer Halyna Hutchins with a gun during a rehearsal, while director Joel Souza, who was grazed by the same bullet, was discharged after treatment. Assistant director David Halls gave celebrity actor Baldwin the prop weapon that had been prepared by armorer Hannah Gutierrez-Reed. Baldwin has filed a claim against Hall, Reed and others. David Halls asked the judge to drop two of the claims against him.
Assistant director, who was the person who handed the loaded gun to actor Alec Baldwin, had shouted “cold” when he gave him the gun. A cold gun means that it is loaded with blanks and has no live ammunition. Unfortunately for Halyna, the gun had a live bullet that struck both her and Souza, killing her and injuring him.
Originally script supervisor Mamie Mitchell filed a suit against many of those involved in the fatal incident stating that she has suffered from “emotional distress” as she was present during the shooting. Later, celebrity actor Alec Baldwin filed a countersuit claiming that crew members, including assistant director Halls were negligent as they allegedly put live ammunition.
David Halls has filed a motion in the Supreme Court in Los Angeles asking it to dismiss two of the three claims that were made in Baldwin’s suit. His attorneys want the court to strike off certain parts of the suit by Baldwin including the punitive damages demanded by the actor but excluding the negligence claim, as of now.
David Hall’s countersuit states that the assistant director does not have any liability and wants the parties whom he has sued to pay any damages that might be assessed against him above any comparative fault that might be found against him in the case.
The assistant director of Rust also alleged that ‘Roe’ defendants had breached a contract to insure him. These still unidentified defendants should have insured him against liability in the case.
According to a court schedule, Judge Michael E. Whitaker will hear the motion filed by Assistant Director David Halls on February 9.
