Alphabet’s Google (GOOGL) has avoided a trial by jury on whether the tech giant had violated antitrust laws. A judge will decide if the company has built a monopoly on the technology used to power online advertising.
The Department of Justice wanted the tech giant to face a jury trial. Still, the defendants argued that monetary damages claimed by the federal government had been compensated to the federal agencies. US District Judge Leonie Brinkema decided in favor of Google.
The Justice Department sought monetary damages as compensation from Google as it said that the tech giant had overcharged federal agencies that had purchased online ads.
In May, Google wrote a check for $2.3 million. This was about three times the damages of $750,000 that the government claimed. Antitrust cases can allow treble the amount asked for as damages.
Google’s spokesperson Peter Schottenfels released a statement that said, “DOJ’s contrived damages claim has disintegrated. We’re glad this case will be ruled by a judge.”
The statement also read, “As we’ve said, this case is a meritless attempt to pick winners and losers in a highly competitive industry that has contributed to overwhelming economic growth for businesses of all sizes. We look forward to making our case in court.”
Google has filed a motion for summary dismissal. This hearing is set for June 21. If the Mountain View, California based company gets a dismissal the case would be terminated without a trial. If it is not dismissed there will be a bench trial in September.
Google is also facing another case that alleges its popular search engine is a monopoly. The closing arguments have already been heard by a judge, but the verdict has not been pronounced yet.
